Sex Offenders

Megan's law is named after 7 year old Megan Kanka, a New Jersey girl who was raped and killed by a known child molester who moved across the street from the family without their knowledge. Megan's law authorizes law enforcement to release to the public information about registered sex offenders. The law is not intended to punish the offender.

The Colorado sex offender registry includes only those persons who have been required by law to register and who are in compliance with the sex offender registration laws. Persons should not rely solely on the sex offender registry as a safeguard against perpetrators of sexual assault in their communities. The crime for which a person is convicted may not accurately reflect the level of risk.

The information provided through this web site is public record. It is made available for the purpose of protecting the public. The accuracy of the records cannot be guaranteed. A Greeley Police Officer verifies the addresses of registered sex offenders. Offenders may have moved and not yet notified or failed to notify law enforcement. Sexual Assault on a Client under C.R.S.18-3-405.5(2)
Sexual Exploitation of a Child by Possession of Sexually Exploitive Material under C.R.S. 18-6—403(3)(b.5)
Indecent Exposure under C.R.S. 18-7-302
Sexual Conduct in a Penal Institution under C.R.S.18-7-701

Juveniles:

1. A juvenile adjudicated for two or more offenses involving unlawful sexual behavior or a for a crime of violence as defined under C.R.S. 18-1.3-406
2. A juvenile who is required to register pursuant to section 16-22-103 because he or she was adjudicated for an offense that would have been a felony if committed by an adult and has failed to register as required by section 16-22-103.

Colorado Revised Statute 16-22-101 et.seq. provides all the rules for registration under Colorado Law. The list held at Greeley Police Department is as complete as possible, and should be more inclusive that the list on the internet. Generally, the registry includes persons convicted of certain unlawful sexual acts either on or after July 1, 1991, or release from the Department of Corrections after July 1, 1994 for which the sentence was for unlawful sexual behavior or for another offense, the underlying factual basis of which involved unlawful sexual behavior.

CITY OF GREELEY COLORADO ORDINANCE NO. 03 , 2009 AN ORDINANCE PROVIDING FOR THE ENACTMENT OF PROHIBITION OF CERTAIN RESIDENCY OF SEX OFFENDERS, DEFINITIONS, AND PROVIDING FOR AFFIRMATIVE DEFENSES TO SAID ORDINANCE CREATING A NEW CHAPTER 10.40 PROHIBITED RESIDENCY OF SEX OFFENDERS.

WHEREAS, sex offenders and predators endanger society; and
WHEREAS, the danger is especially great for the community's youth; and
WHEREAS, restricting sex offenders from living near locations where youth congregate lessens the potential for the offender to come into contact with youth; and
WHEREAS, this Ordinance promotes and protects the public safety, health and welfare of the citizens of Greeley.

NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF GREELEY, COLORADO

Section 1. A new chapter shall be created as follows:

Chapter 10.40 Prohibited Residency of Sex Offenders

10.40.010 Findings and Intent

a. City Council finds that Sexual predators and Specified Sex Offenders who use physical violence or who prey on children pose an extreme threat to public safety. Sexual predators and Specified Sex Offenders endanger society. Removing Sex Offenders from the regular proximity of places where children are located, and limiting the frequency of contact between Sexual Predators and Specified Sex Offenders and children will reduce the opportunity and risk for offenses to be committed.

b. This chapter is intended to serve the City's compelling interests to promote, protect and improve the health, safety and welfare of the public by creating areas, around locations where children regularly gather in concentrated numbers, where Sexual Predators and Specified Sexual Offenders are prohibited from establishing either temporary or permanent residence. 10.40.020 Definitions.

For the purpose of this chapter, the following terms shall have the following meanings:

A. Park means any public park including playgrounds.
B. Permanent residence means a place where a person abides, lodges or resides for five (5) or more consecutive days.
C. Recreation center means a publicly owned recreation center including but not limited to the Downtown Recreation Center, the Fun Plex, and the Rodarte Center.
D. School means any public, private, parochial, charter or other school attended by students under the age of eighteen (18) except for home schools.
E. Sexual Predator means any person who has been found to be a sexually violent predator pursuant to Section 18-3-414.5 of the Colorado Revised Statutes.
F. Specified Sex Offender means any person who has been required to register under the Colorado Offender Registration Act, CRS §§ 16-22-101, et seq. who has been: 1. convicted of a felony for an offense requiring registration; or 2. has multiple convictions for offenses requiring registration; or 3. whose offense(s) requiring registration involved multiple victims.
G. Swimming Pool means a privately or publicly owned water filled structure used for the purpose of swimming or other water activities including splash parks. Swimming pool as used in this section shall not include any water filled structures located at private, single family residences.
H. Temporary residence means a place where a person abides, lodges or resides for a period of five (5) or more days in an aggregate calendar year and which is not the person’s permanent residence; or a place where a person routinely abides, lodges or resides for a period of five (5) or more consecutive or non-consecutive days in any month and which is not the person's permanent address.

10.40.030 Prohibition:

A. It shall be unlawful for a Sexual Predator or a Specified Sex Offender to establish a permanent or temporary residence within seven hundred fifty feet (750) of any school, park, playground, recreational center or swimming pool.
B. It shall be unlawful to let or rent any portion of any property, room, place, structure, trailer or other vehicle to a Sexual Predator or Specified Sex Offender with the knowledge that it will be used as a permanent or temporary residence in violation of this chapter.

10.40.040 Exceptions.

A. A Sexual Predator or Specified Sex Offender is not guilty of a violation of Section 10.40.030 if:

1. The Sexual Predator or Specified Sex Offender had established the permanent or temporary residence prior to the effective date of this chapter; provided, however, that this exception shall not apply if the Sexual Predator or Specified Sex Offender committed and was subsequently convicted of an offense for which registration under the Colorado Sex Offender Registration Act is required, after the effective date of this chapter;
2. The Sexual Predator or Specified Sex Offender is placed in the residence pursuant to a State of Colorado licensed foster care program; or
3. The school, park, playground, swimming pool or recreation center was opened after the Sexual Predator or Specified Sex Offender established the permanent or temporary residence.
B. A person who lets or rents any portion of any property, room, place, structure, trailer or other vehicle to a Sexual Predator or Specified Sex Offender with the knowledge that it will be used as a permanent or temporary residence in violation of this chapter is not guilty of a violation of Section 10.40.030 if:
1. The person let or rent the property, room, place, structure, trailer or other vehicle to the Sexual Predator or Specified Sex Offender prior to the effective date of this chapter;
2. The person lets or lets or rents the property, room, place, structure, trailer or other vehicle to a Sexual Predator or Specified Sex Offender pursuant to a State of Colorado licensed foster care program; or
3. The person let or rent the property, room, place, structure, trailer or other vehicle to the Sexual Predator or Specified Sex Offender prior to the opening of any school, park, playground, swimming pool or recreation center.

10.40.050 Measurement.

For purposes of determining a minimum distance separation required herein, the measurement shall be made by following a straight line from the outer property line of the property on which the school, park, playground, swimming pool or recreational center is located to the nearest point on the outer property line of the property in which the permanent or temporary residence is located.

10.40.060 Penalties. Violations of this Chapter 10.40 are subject to any and all penalties as provided in Chapter 1.32 of this Code.

Section 2. This Ordinance shall become effective five days following its final publication as provided by the Greeley City Charter.
